Horse float hire WA only

We are hiring out an extended double Kentucky Horse Float. The hire rates for use in metro area are:

• $35  per half day
• $65  per day day
• $11o   two days
• $165  three days
• $220  four days
• $275  five days
• $330  six day
• $ 350  seven days

Conditions of Hire of Horse float with registration SJ 2936

1.        ("the float") supplied on hire remains property of Antje Lopez ("the owner")

2.        'The Hirer' means the person, firm or corporation to whom the float is hired and includes any contractor, employee agent or other person claiming through, under or in trust for any such person, firm or corporation.

3.        The float returned late and / or damaged will be charged for.

4.        Tyres and punctures are hirer's responsibility.

• Hire rates are based on time out not time used.
• Rates are based on an eight hour day.
• Rates are quoted on the basis of collection and return by the hirer to the owner.
• Delivery and collection can be arranged by the owner, at an extra charge.
• Cleaning charges may apply where the float is returned in unreasonably dirty condition
• The float to be returned promptly and without retention to the owner at the end of the hire period without demand by the owner and the hirer acknowledges and agrees that the float shall be returned by 5 pm on the return date otherwise additional hire cost will be incurred.

The hirer agrees with the owner that the hirer during the hire period:

• Shall maintain the float in good order, condition and repair and the hirer shall not have or be deemed to have any authority to pledge credit on the owner or create any lien upon the float for repair or otherwise.
• Shall not part with personal control of the float
• Shall not sell, mortgage, sublet or assign the float
• Shall peacefully permit the owner or the officers, servants and agents acting on behalf of the owner to enter the premises of the hirer and recover the float.
• Shall pay the owner any reasonable costs and expenses including legal costs which the hirer may incur by reason of the repossession or attempted repossession of the float or the issuing of an authority to repossess the float or the recoveries of monies the hirer owing to the owner pursuant to this hire contract.
• Shall repay to the owner any monies which the owner may be required to pay to protect the float or to make good any failure by the hirer to comply with the obligations of the hirer.
• Shall not bring or maintain or be a party to or assist any claims or actions whatsoever made in respect of the float or any injury, damage or inconvenience arising from its use.
• Shall indemnify the owner against any claims or actions whatsoever made in respect of the float or any injury, damage or inconvenience arising from its use
• Shall not remove or allow the float to be removed from Perth Metropolitan area without the expressed consent of the owner.
• Shall advise the owner immediately of any breakdown of the float. If no advice to the owner is given, no allowance time lost will be given. The hirer is not to attempt to repair the float without permission.

5.        The hirer agrees that the Hirer is responsible for any loss or damage whatsoever caused to any person or property as a consequence of the hirer's use of the float.

6.        The owner may from time to time obtain insurance to limit the personal liability of the owner and the hirer, however, the hirer is responsible for any loss or damage to the float from the time the hirer takes delivery of the float from the owner until the owner has received the float back from the hirer. The hirer agrees to pay full replacement costs for the loss of or damage of the float in a manner the owner considers unrepairable within (7) days of the loss or damage coming to the attention of the owner.

7.        Anytime or other indulgence granted by the owner shall not affect the strict right of the owner under this hire contract

8.        If any of these conditions of hire are or become for any reason wholly or partly invalid that condition shall to the extent of the invalidity be served without prejudice to the continuing force and validity or all the remaining conditions.

9.        Time shall be deemed to be the essence of this hire contract in all respects.

Severability

In the event any part or parts of this contract are deemed to be unenforceable or illegal, all other provisions of this contract shall remain in force.

10.     The hire contract and these conditions shall be governed by and construed and take affect in accordance with the law of the State of Western Australia.
